Please read these terms carefully before using our services

About Our Services

Webspain provides professional web design, development, and digital solutions to businesses worldwide. We specialize in creating custom websites, web applications, native mobile apps, and cloud-based platforms that help our clients succeed in the digital space.

Our services include but are not limited to: website design and development, web application development, native app development, API and infrastructure services, hosting and maintenance, consulting, and AI integration.

Ongoing Support & Maintenance

We are committed to supporting our ongoing customers with comprehensive maintenance services. This includes:

  • Bug fixes and technical issue resolution
  • Regular security updates and patches
  • Performance optimization and monitoring
  • Technical support via email and video calls
  • Content updates and minor modifications (as per service agreement)

Important: Support and maintenance are provided to active customers with current service agreements. Response times and scope of support vary based on your service plan.

Warranty & Liability

While we strive for perfection and reliability, please note the following:

  • We do not offer warranties or guarantees against downtime, errors, or bugs
  • We are not liable for any compensation in case of service interruptions or technical issues
  • We make every reasonable effort to maintain uptime and resolve issues promptly
  • Business-critical services should implement appropriate redundancy and backup strategies

Our responsibility is limited to addressing and resolving issues as they arise, with reasonable efforts to minimize impact. We cannot guarantee 100% uptime or error-free operation, as this depends on multiple factors including third-party services, hosting infrastructure, and internet connectivity.

Hosting & Infrastructure

We partner with industry-leading hosting providers to ensure your website or application runs on reliable, secure, and performant infrastructure. Our hosting solutions include:

  • Selection of appropriate hosting environment based on your needs
  • Configuration and optimization of servers and infrastructure
  • SSL certificates and security hardening
  • CDN integration for global performance
  • Monitoring and alerting systems

Hosting costs are separate from development costs and are billed according to actual usage and selected service tier. We work with providers such as Vercel, AWS, Digital Ocean, and others to match your specific requirements.

Backups & Data Protection

We implement daily automated backups for all hosted websites and applications. Backups include:

  • Database snapshots (daily retention: 30 days)
  • File system backups (media, uploads, configuration)
  • Version-controlled code repositories
  • Disaster recovery procedures

Your Responsibility: While we maintain regular backups, you are ultimately responsible for maintaining your own copies of critical data and content. We recommend downloading important content regularly as an additional precaution.

Content Responsibility

You retain full ownership and responsibility for all content published on your website or application. This includes:

  • Text, images, videos, and other media
  • Product descriptions and pricing
  • Legal compliance (privacy policies, terms, disclaimers)
  • Copyright and intellectual property rights
  • Accuracy and appropriateness of published information

You agree to indemnify Webspain against any claims arising from your content. We reserve the right to remove content that violates laws or our acceptable use policies.

Design & Intellectual Property

Upon final payment, full design copyright and ownership are transferred to you. This includes:

  • Custom design elements, layouts, and graphics created specifically for your project
  • Logo variations and brand materials (if included in scope)
  • UI/UX designs and wireframes
  • Custom illustrations and iconography

Note: This does not include third-party assets, stock photography, fonts, or open-source libraries used in your project, which remain subject to their respective licenses.

Content Management Systems (CMS)

When we implement a headless CMS solution such as Prismic, Contentful, or similar platforms:

  • Full administrative access and ownership are transferred to you
  • You receive admin credentials and complete control
  • We provide training and documentation for content management
  • The CMS account is registered under your organization
  • All content and data remain your property

We can continue to provide support and training for CMS usage as part of ongoing maintenance agreements.

Source Code Access

Our standard service packages include the deployed website or application but do not include direct source code access. This means:

  • We maintain and host the codebase on your behalf
  • Updates and modifications are made by our team
  • You retain full ownership of the final deployed product
  • Source code can be purchased separately if required

Source Code Purchase: If you require full source code access for internal development or migration, this can be arranged through a separate agreement with additional fees covering code documentation, transfer, and handover support.

Proprietary Platform Services

Our specialized platform solutions (Property Manager, Education Platform, Marketplace Platform, etc.) are proprietary software-as-a-service offerings. Regarding these platforms:

  • Source code and backend access are not included in standard subscriptions
  • You receive fully functional, customized instances of these platforms
  • API access is provided for integrations and data management
  • Custom features can be developed and integrated into your instance
  • Platform code can be licensed separately under enterprise agreements

If you require white-label licensing or full platform access, we offer enterprise licensing agreements that can be negotiated based on your specific needs.

Service Termination & Data Retention

When you decide to end your service relationship with Webspain:

  • We provide 30 days notice before final termination
  • All website data, databases, and files are made available for download
  • After the retention period, all data is permanently deleted from our systems
  • Backup copies are removed according to our data retention policy
  • DNS and hosting configurations are transferred or terminated as requested

Important: Please ensure you download all necessary files, databases, and content before the termination date. Once data is deleted, it cannot be recovered.

We can assist with migration to another provider or export data in standard formats upon request during the notice period.

Company Information

Webspain is a registered company operating in Spain. We comply with Spanish and European Union regulations regarding:

  • Data protection (GDPR)
  • Consumer rights
  • Digital services
  • Business practices and taxation

Our business registration details are available upon request. All contracts and agreements are governed by Spanish law, and any disputes are subject to the jurisdiction of Spanish courts.

Changes to Terms

We reserve the right to update these Terms of Service as our business evolves and regulations change. When significant changes are made:

  • Active customers will be notified via email
  • Changes take effect 30 days after notification
  • Continued use of services constitutes acceptance of updated terms
